

Mr. Golden negotiates early reasonable settlements in complex accident and commercial disputes, avoiding or shortening litigation and significantly reducing client costs. Adapting theory learned at the Program on Negotiation at Harvard Law School to the practical needs of firm clients, he provides leadership in an area of legal practice he describes as “negotiation counsel.” (click on "Negotiation Counsel" above for further information).

Jim Golden has attracted academic and professional interest for his leadership in creating "negotiation counsel" as a legal practice area. He has spoken in venues including the Harvard Law School, Harvard Business School, International Institute of Conflict Prevention and Resolution, Corporate Counsel Summit, Association of Corporate Counsel and the ABA Transportation Megaconference. Mr. Golden recently proposed the use of negotiation counsel to resolve a wide range of disputes at CFO Summit XV, where Alan Greenspan delivered one of the two keynote addresses. Mr. Golden delivered the other keynote. Mr. Golden's work as negotiation counsel is the subject of a case study taught at the Harvard Business School.
Mr. Golden has wide-ranging experience negotiating in the public sector. He has negotiated and consulted with senior staff of the President of the United States as well as the primary presidential administration draftsman of the post-Soviet Ukrainian Constitution. He has also conducted negotiations in China.
Mr. Golden's article detailing the benefits of using "negotiation counsel" to quickly and reasonably resolve high-stakes disputes was published in the Harvard Negotiation Law Review, 13 Harv. Mr. Golden graduated from Lee College, now known as Lee University, (B.S.), and the University of Tennessee College of Law (J.D.) where he was champion of the Moot Court Competition.

Admitted to the Tennessee bar in 1978, Mr. Golden is licensed to practice law before all Tennessee state and federal courts. Mr. Golden serves on the Council of Distinguished Advisors of the Straus Institute for Dispute Resolution at Pepperdine University School of Law. He has served as a client supervisor in the Harvard Law School Negotiation and Mediation Clinical Program.
