Law Alert: FMCSA Extends Emergency Declaration Through August 14, 2020

The FMCSA announced today an extension of its Modified Emergency Declaration through August 14, 2020, allowing motor carriers and drivers providing direct assistance to the COVID-19 emergency relief efforts to continue operating under the exemptions set forth in the declaration through that date. According to the agency, the ongoing national emergency continues to exist and warrants extension of the declaration, which was previously set to expire on July 15th.

Similar to the last extension in June, this extension is limited to the transportation of (1) livestock and livestock feed; (2) medical supplies and equipment related to the testing, diagnosis and treatment of COVID-19; and (3) supplies and equipment necessary for community safety, sanitation, and prevention of community transmission of COVID-19 such as masks, gloves, hand sanitizer, soap and disinfectants. In its June extension, FMCSA concluded there was no longer a need for emergency relief with respect to other categories of transportation, including food and fuel, and, therefore, removed those categories.
