Prepare Now for September 30, 2019 EEO-1 Pay Data Reporting Deadline

After much wrangling in the courts, the deadlines and requirements for the Equal Employment Opportunity Commission’s new pay data reporting requirement have now been set.  Under this new requirement, covered employers (e.g. those with 100 or more employees; qualifying government contractors) must supplement their EEO-1 Form with new information consisting of W-2 earnings and hours worked in 12 pay bands for each of 10 job categories.  The pay data, which is being collected to examine the presence of gender and race-based pay gaps, must be provided under “Component 2” of the updated EEO-1 Form.  Employers must provide their pay data for 2017 and 2018 to the EEOC by September 30, 2019

The EEOC has reported that it will begin collecting all pay data by mid-July.  Employers are urged to begin internally collecting the pay data to meet the September 30th deadline.
