Today’s workforce is increasingly aware of the costs associated with and the need to plan for retirement, as well as the ever-increasing cost of medical care. As such, the availability of employee pension and welfare benefit plans is often second only to salary and wage amounts in importance with respect to recruiting and retaining highly qualified employees. Those same factors – the increasing administrative cost of pension programs and skyrocketing medical care costs – have created both the need for employers’ increased scrutiny of administrative oversight of such programs and the recognition that the likelihood of litigation relating to eligibility and claims administration is on the rise.
